Divorce Lawyers in Delhi NCR: Wife की Private Photos या WhatsApp Chats Court में डाल दीं तो?
कभी-कभी matrimonial dispute इतना bitter हो जाता है कि husband सोचता है — “जो evidence मेरे पास है, सब Court में लगा देता हूँ.”
लेकिन हर private photograph, WhatsApp chat, video या personal document को खुले record में लगा देना safe strategy नहीं है.
Delhi High Court ने 1 July 2026 को एक important warning दी.
एक divorce proceeding में estranged husband की तरफ से पत्नी की अत्यंत private photographs divorce petition के साथ annex कर दी गई थीं. Photographs allegedly उस WhatsApp communication का हिस्सा थीं जो wife और her doctor के बीच था.
सबसे बड़ी problem?
वे photographs without redaction और बिना sealed cover protection के court record में लगा दी गई थीं.
Delhi High Court ने इसे serious lapse माना.
Court ने कहा कि अगर कोई private material matrimonial dispute में genuinely relevant भी माना जा रहा हो, तब भी उसे sealed cover, appropriate redaction और Court की permission के साथ पेश करने का सवाल आता है.
और बात सिर्फ photographs तक सीमित नहीं है.
Court की earlier directions में private letters, emails, WhatsApp chats, text messages, videos, CCTV footage और electronic evidence जैसे sensitive material को भी cover किया गया है.
Husband के लिए practical warning
अगर आपके पास wife के खिलाफ कोई sensitive digital evidence है —
private photographs, intimate chats, medical communications, videos या personal emails — तो उसे WhatsApp groups, relatives या social media पर forward करना तो बिल्कुल अलग risk है.
लेकिन Court filing में भी उसे casually attach कर देना जरूरी नहीं कि सही तरीका हो.
पहले यह देखना जरूरी है:
क्या evidence genuinely relevant है?
क्या पूरा document लगाना जरूरी है?
क्या redaction possible है?
क्या sealed-cover permission लेनी चाहिए?
और हाँ, यह principle one-sided नहीं है.
इस case में Court ने यह भी note किया कि wife ने बाद में husband की photographs/videos record पर रखीं. Court ने कहा कि matrimonial litigation को “mutual humiliation” की contest नहीं बनना चाहिए.

अगर divorce petition, matrimonial complaint या court proceedings already चल रही हैं, तो digital material के मामले में “पहले डाल देते हैं, बाद में देखेंगे” वाला approach भारी पड़ सकता है.
