If you are a husband facing a CAW Cell Delhi complaint, this is exactly the kind of question you should be asking from Day One.
The Delhi High Court judgment dated 8 January 2026 in Aditya Mohan Nigam & Anr. v. State (NCT of Delhi) & Anr. is worth reading carefully.
The matrimonial dispute had travelled through several proceedings.
The FIR was No. 467/2016, registered under Sections 498A/406/34 IPC.
The allegations were not confined to the husband. The father-in-law, mother-in-law and brother-in-law also came into the picture.
But when the Delhi High Court examined the criminal allegations closely, one problem became very important:
Were the allegations actually specific against each accused person?
The Court found that many allegations used general expressions such as “in-laws” without properly identifying the individual accused, the particular act, dates, circumstances or specific role.
That distinction matters enormously in a CAW CELL DELHI matter.
You cannot simply put every member of a family into one paragraph and expect the legal consequences to be identical for everyone.
In this case, the Court also examined the allegation concerning the wife's jewellery.
The complaint alleged that jewellery had been handed over to the mother-in-law for safekeeping in a bank locker.
But the husband and father-in-law were the petitioners before the High Court, and the Court noted that the complaint did not even allege that these two petitioners had custody, control or possession of that jewellery. The Court therefore found that the necessary element of entrustment was not made out against them.
There was another important part.
Earlier DV Act proceedings had already been examined by the trial court, and the allegations of domestic violence against the parents-in-law were found unsubstantiated. The husband had also obtained a divorce judgment in 2025 in which the Family Court recorded findings of mental cruelty against him.
The Delhi High Court then considered the complete history rather than looking at the FIR in isolation.
Its conclusion was significant:
The allegations were found to be vague, omnibus and generic, and the Court concluded that the FIR did not disclose the necessary ingredients of Sections 498A and 406 against the petitioners.
The FIR and subsequent proceedings were therefore quashed.
Now put yourself in the position of a husband receiving a CAW Cell Delhi notice.
Would you simply reply:
“सब ठीक हो जाएगा.”
I would not treat it so casually.
First make a person-wise chart:
Husband — what exactly is alleged?
Father — what exactly is alleged?
Mother — what exactly is alleged?
Brother/sister — what exactly is alleged?
Then make a second chart:
Date. Incident. Place. Document. Witness. Police complaint. Medical record. Message.
This is particularly important in Delhi NCR matrimonial disputes, because an allegation against “the family” and a specific allegation against a particular individual are not the same thing.
The judgment also gives another practical lesson for a husband and his family:
If there are already DV proceedings, Family Court proceedings, property proceedings, mediation records, police complaints or previous statements, preserve them.
