Men Cell Delhi: Wife
Family Court ने पहले wife का right close किया, लेकिन बाद में उसकी application पर Written Statement का right restore कर दिया।
Section 23 of the Hindu Marriage Act
इस particular case में Court ने husband के own non-compliance और उसके बाद defence strike off करवाने की कोशिश को साथ में देखा।
यहीं Men Cell Delhi, Mencell Delhi और Purush Aayog Delhi के सामने आने वाले husbands के लिए एक practical lesson है।
अगर आपका सवाल है “Can husband get wife’s defence struck off for delay?”, तो answer automatic yes नहीं है। Court surrounding circumstances, previous orders, reasons for delay और parties के own conduct को देख सकती है।
Men Cell, Men Cell Delhi, Mencell

इसका general meaning यह नहीं है कि every delayed Written Statement must be accepted; the Court considered the husband’s own failure to comply with the litigation-expense direction and the resulting circumstances.
